These Terms and Conditions (hereinafter "T&Cs") apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter "Customer") and Royal Creations GmbH, Hauptstrasse 38, 4103 Binningen, Switzerland (hereinafter "Seller") via the online shop.
Deviating or conflicting terms and conditions of the Customer are not recognized unless the Seller has explicitly agreed to their validity in writing.
A consumer is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a legally recognized partnership who acts in the exercise of their trade, business, or profession.
The products displayed in the online shop do not constitute a legally binding offer, but an invitation to place an order. By submitting an order, the Customer makes a binding offer to conclude a purchase contract.
The contract is concluded by any of the following:
The contract text is stored and transmitted electronically to the Customer. The contract language is German.
Under Swiss law, there is generally no statutory right of withdrawal for online purchase contracts.
Royal Creations GmbH voluntarily grants consumers the right to withdraw from the contract within 14 days from receipt of the goods. To exercise this right, a clear written statement by email or letter is required — sent to the address above. Timely dispatch of the notice is sufficient to meet the deadline.
Consequences of withdrawal:
In addition, the Seller grants a voluntary return policy of 30 days from receipt of the goods, subject to the following conditions:
The Customer bears the return shipping costs. This voluntary policy does not affect mandatory statutory claims.
All prices are in Swiss Francs (CHF) and include statutory VAT. Shipping costs are shown separately. The purchase price is due immediately upon ordering. When paying via external payment service providers, their terms and conditions apply additionally.
Delivery is made to the address provided by the Customer. Delivery times are non-binding unless explicitly agreed otherwise in writing. Partial deliveries are permitted if reasonable for the Customer.
If the Customer is in default of acceptance, the Seller is entitled to charge any resulting additional costs. Risk passes to the Customer upon handover of the goods. For entrepreneurs, risk passes upon delivery to the transport company.
The delivered goods remain the property of Royal Creations GmbH until full payment has been received. The Seller is entitled to register the retention of title in the relevant registry.
The statutory provisions of Swiss law apply, in particular the Swiss Code of Obligations (OR). Entrepreneurs must inspect goods immediately upon receipt and report any defects in writing without delay (Art. 201 OR). For justified defects, the Seller has the right to remedy or replacement delivery. The warranty may be excluded for used goods sold to entrepreneurs.

For slightly negligent breaches of essential contractual obligations, liability is limited to typically foreseeable damages. Otherwise, liability is excluded to the extent legally permissible.
Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the consumer's country of residence remain reserved.
The place of jurisdiction is the registered office of Royal Creations GmbH in Binningen, Switzerland. For consumer claims, the mandatory jurisdiction rules under Swiss law apply.
Royal Creations GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
